Liability

The liability of Timea shall be limited to wilfull intent and gross negligence. In case of slight negligence Timea shall only be liable for the breach of material obligations („Kardinalpflicht“), that is essential for achieving the purpose of the contract or in case of the breach of an obligation, enabling the fulfilment of the contract and regularly trusted on by the other party. In such cases the liability is, however, limited to the reasonably foreseeable damage that is typical for the respective contract.

The above outlined limitation of liability shall, however, not be applicable for the culpably injury of life, body and health. A possible liability arising from the German Product Liablity Act („Produkthaftungsgesetz“) shall not be effected by the above outlined limitation of liability.

 

Ancillary agreements, Place of jurisdiction, Applicable law, Language

Ancillary agreements as well as changes and amendments to this Terms of Use require written form to be effective. The same shall appliy to this requirement of written form.

 

This Terms of Use and all issues regarding the Website are governed by the laws of the Federal Republic of Germany. The UN-Convention on Contracts for the International Sale of Goods (CISG) as well as the Private International Law shall not apply.

Place of jurisdiction is - insofar legally allowed - Munich, Federal Republic of Germany. Only the German version of this privacy policy is applicable. The English version is for information purposes only
